  1. Application  

1.1 General information on these Terms of Use  

Thank you for visiting https://eu.healy.shop/. This website is operated by Healy International B.V. as a company incorporated and existing under the laws of The Netherlands with its business address at Paterswoldseweg 806, 9728 BM, Groningen, The Netherlands, BTW ID: 858024068, 
CCI Number: 69816875, Email: contact.emea@healy.world hereinafter referred to as “Healy World”. 

Access to and use of the content, information, and services available on this website are subject to acceptance and compliance with the terms and conditions set out below in their latest version. We encourage you to read these terms carefully before using our website. By accessing it, you enter into a legally binding agreement with Healy World, which governs your use of our website, including all services available on it, as well as any purchases of Healy World products or subscriptions to programs offered by us.  

They apply to all contracts concluded via the official website http://eu.healy.shop/ (the “Website”) of Healy International B.V. with a customer who is a consumer, i.e. any natural person who enters into a legal transaction for purposes that are predominantly outside his or her trade, business or profession (hereinafter “Consumer” or “You”). 

These Terms and Conditions are divided into three parts: 

  • Part A: Regulations applying for the purchase of a Healy World product 
  • Part B: Special provisions for the conclusion of a Healy World subscription  
  • Part C: Further provisions, which apply both to the purchase of a Healy World Product and to a conclusion of a Healy World subscription   

1.2 Acceptance of Terms  

By registering, subscribing to paid services or purchasing products or other content, you agree to these Terms and Conditions. By accessing or using a website or service controlled by Healy World, you also agree that you are legally authorized to accept the Terms and Conditions on your behalf and on behalf of all parties you represent in connection with your use of a website or service. If you do not agree to the terms and conditions, you are not authorized to use any website or service.  

Part A – BUYING A HEALY WORLD PRODUCT 

  1. CONCLUSION OF THE CONTRACT 

2.1 The presentation of Healy World products on the website does not constitute a legally binding offer, but a non-binding product catalog. Errors and omissions excepted. 

2.2 By placing an order on the Website, the consumer makes a binding offer to purchase the respective Healy World products and thus to enter into a purchase agreement (“Agreement“). 

2.3 In orderto place an order, the consumer may first place Healy World products in the shopping cart without obligation and then correct his entries at any time by using the “Back” button on his browser before placing the binding order. In the shopping cart itself, he can change the quantity of a product or remove a product from the shopping cart at any time. 

2.4 After that, the consumer must enter all data relevant for processing the order (first and last name, billing and delivery address, selection of payment method and payment data, e-mail address). During the ordering process, Healy World provides the consumer with technical means in the form of a customary completeness and plausibility check (checking whether all mandatory fields have been filled in and whether the characters entered match the corresponding mandatory field), with the help of which the consumer can identify any errors in input. Subsequently, the consumer’s order data is summarized once again for verification. 

2.5 By clicking the button “order subject to payment” the consumer places a binding order for the Healy World products contained in the shopping cart. The consumer can only place a binding order if he has taken note of and accepted these GTC and if he has taken note of the privacy policy and the cancellation policy according to section 9 and confirmed this by placing a check mark in the field “I have taken note of and accepted the privacy policy and the GTC” as well as in the field “I have taken note of the cancellation policy” before clicking the aforementioned button “Order subject to payment”. 

2.6 The General Terms and Conditions can be printed via the “Print” function and saved via the “Save” function.  

2.7 Healy World shall immediately confirm receipt of the order by automatically generated e-mail to the consumer (“Confirmation of Receipt“). The Confirmation of Receipt does not constitute an acceptance of the order, unless such acceptance is expressly stated in the Confirmation of Receipt, in which case the contract shall be concluded by such acceptance. Otherwise, a contract shall be concluded at the time Healy World accepts the order by e-mail to the customer (“Order Confirmation“), at the latest, however, when the ordered Healy World products are shipped in accordance with Sections 1 and 6.2 and the consumer receives another separate e-mail with the shipping information (“Shipping Confirmation“) from Healy World. The order or shipping confirmation will also contain all details of the contract (including the details of the order and these General Terms and Conditions and the Privacy Policy). 

2.8 If the acceptance of the consumer’s order is not expressly declared within five working days after receipt of the order confirmation by sending the order or shipping confirmation, the consumer’s offer to conclude the contract shall be deemed rejected. 

2.9 Healy World shall use reasonable efforts to provide a specific, clear and detailed description of the features, price and availability of each Healy World Product offered by Healy World. 

  1. “FAST START” PROMOTION  

3.1 Promotion 

The “Fast Start” promotion is designed to reward Healy World members who, just after joining, successfully onboard new members who purchase Healy World products. Rewards are awarded in two stages: “Onboarding + 1” and “Onboarding + 2”, indicating that the new member’s enrollment and product purchase must occur within the first or second month after joining. For more details on the “Fast Start” promotion, we invite you to consult the brochure available in the download section of our BackOffice.  

3.2 Get a “Device Bonus” with “Fast Start” 

By participating in the “Fast Start” promotion, you have the opportunity to receive a Healy World device free of charge as a bonus (options: Healy Gold Edition, Healy Holistic Edition, Healy Resonance Edition or Healy Resonance Plus Edition), depending on your qualification level.  

3.3 Fast Start Device Conditions  

Devices obtained through the Fast Start promotion are considered a business gift and become the property of Healy World members. THESE DEVICES ARE NOT TO BE RESOLD AND ARE GIVEN FOR THE SOLE PURPOSE OF SUPPORTING THE MEMBER IN PROMOTING THEIR BUSINESS WITHIN HEALY WORLD.  

  1. REWARDS  

4.1 Promotion 

The “Rewards” promotion is designed to reward Healy World members who earned benefits through “Fast Start”, promotions or incentives. The list of rewards is available in the shop account, under “Rewards”. You can select the reward you want to redeem, make sure to verify your delivery address and click on “order”. Please, note that the maximum period to redeem your rewards is up to three months. If you don’t redeem your rewards within the 3 month period, they will expire and will be listed under “Expired“, under the rewards tab.  

4.2 Get a “Device Bonus” or a “Subscription Bonus” with “Rewards” 

By participating in the “Rewards” promotion, you have the opportunity to receive a Healy World product free of charge as a bonus, depending on your qualification level.  

4.3 Rewards Conditions 

Devices obtained through the Fast Start promotion are considered a business gift and become the property of Healy World members. THESE DEVICES ARE NOT TO BE RESOLD AND ARE GIVEN FOR THE SOLE PURPOSE OF SUPPORTING THE MEMBER IN PROMOTING THEIR BUSINESS WITHIN HEALY WORLD.  

  1. PRICES; TERMS OF PAYMENT  

5.1 Prices  

The prices stated on the website in euros include the statutory value added tax and other price components and are exclusive of the respective flat rate shipping costs, which are automatically displayed in the shopping cart. The total purchase price for the products ordered by you including VAT and, if applicable, shipping costs will also be displayed in the order mask before you submit your order.  

5.2 Methods of payment 

Payment shall be made via the payment method selected by you in the order process 
The following payment methods are available: 

  • Credit card: VISA, MasterCard, American Express 
  • PayPal, SOFORT and iDEAL

               The data is encrypted during transmission using the SSL (Secure Socket Layer) protocol, which ensures the safe flow of this information. The payment module is outsourced to Payabl. (https://payabl.com), which specializes in secure online payments; the security system used is currently one of the most secure according to the PCI-DSS standard. 
Important note: the list is not exhaustive and the separate privacy policies of the card and payment providers apply to all transactions. 

               We continue to offer the following payment options in cooperation with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden. The payment is made to Klarna in each case: 

  • Invoice: The payment term is 14 days from the shipment of the goods and/or the provision of the service. The full invoice terms for the countries where this payment method is available can be found on Klarna’s website. 
  • Installment purchase: With Klarna’s financing service, you can pay for your purchase in fixed or flexible monthly installments under the conditions specified in the checkout. The installment payment is due at the end of each month after Klarna sends you a monthly invoice. 

              The use of the payment methods invoice and installment purchase requires a positive credit assessment. In this respect, we forward your data to Klarna for the purpose of the address and credit check as part of the purchase initiation and processing of the purchase contract. Please understand that we can only offer you those payment methods that are permitted based on the results of the credit check. General information about Klarna can be found here. Your personal data will be treated by Klarna in accordance with the applicable data protection regulations and as specified in Klarna’s privacy policy. 

              The consumer shall receive invoices and credit notes for each binding order exclusively in electronic form. Upon receipt of the invoice, the invoice amount stated therein is immediately due for payment in full.  

               In case of default of payment, Healy World is entitled to its statutory rights.  

  1. DELIVERY; RESERVATION OF TITLE 

6.1 A product order will be delivered to the address provided by the consumer to Healy World. 

6.2 Healy World shall deliver the ordered Healy World products at the latest within 30 calendar days after conclusion of the purchase contract. 

6.3 Healy World reserves the right not to refund the delivery charges paid by the consumer if, after payment of the delivery charge and initiation of delivery, the consumer wishes to change the delivery method to a lower-priced delivery option or to self-collection or to a new, lower-priced delivery address.  Healy World also reserves the right to charge the additional delivery fees incurred if the consumer subsequently changes the address provided or wishes to change the method of delivery to a higher priced delivery option. 

6.4 Healy World reserves the unrestricted right to deliver a product order, or any part thereof, prior to the expected delivery date, provided that this is reasonable and without further cost to the consumer. 

6.5 The risk of loss of or damage to the Healy World Product that is the subject of an Order shall pass to the Consumer (a) when the Consumer or a third party other than the carrier designated by the Consumer has taken possession of the Healy World Product; or (b) upon delivery of the Healy World Product to the carrier if the carrier has been engaged by the Consumer to transport the Product and such choice has not been offered by Healy World, without prejudice to the Consumer’s rights against the carrier. 

6.6 Notwithstanding any limitations on delivery and/or transfer of risk, Healy World shall retain title to the Healy World Products until Healy World has received payment in full for all Healy World Products that are the subject of an Order. 

  1. RIGHTS OF DEFECT 

7.1 In the event of defects in Healy World products, the consumer is entitled to demand supplementary performance, to withdraw from the contract or to reduce the purchase price within the scope of the statutory provisions. 

7.2 The period for asserting claims based on defects shall be two years and shall commence at the time the respective Healy World products have been delivered to the consumer. Claims based on defects which Healy World has fraudulently concealed or which are subject to a quality or durability guarantee shall remain unaffected by this clause 7.2. 

7.3 Claims for damages due to defects are subject to the statutory provisions, modified by the provisions in clause 7. 

  1. LIABILITY 

8.1 Healy World shall always be liable irrespective of the nature of the breach of its obligations under the contract, including tort, if the breach of obligation is due to intent or gross negligence. 

8.2 In case of breach of essential contractual obligations by Healy World, its legal representatives or vicarious agents, the fulfillment of which makes the proper execution of the contract possible in the first place and on the observance of which the contractual partner may generally rely, Healy World shall be liable for any breach due to negligence; in case of slight negligence, however, liability shall be limited to the typical damage foreseeable at the time of conclusion of the contract. 

8.3 Limitations and exclusions of liability according to this clause 8 do not apply: 

  • In case of injury to life, body or health,  
  • In case of fraudulent concealment of defects,  
  • In the event of liability for claims under the Product Liability Act,  
  • In the event of gross negligence on the part of Healy World’s executive bodies or officers, or 
  • As far as Healy World has assumed a guarantee of quality or durability. 
  1. As far as liability is excluded or limited according to this clause 8, this also applies to employees, representatives and vicarious agents of Healy World. 
  1. The above liability provisions shall apply mutatis mutandis to futile expenses.  
  1. Healy World is not liable for damages resulting from improper use of the Healy World products by the consumer.  
  1. RIGHT OF REVOCATION 

9.1 Cancellation policy 

You have the right to cancel this contract within fourteen days without giving any reason. 

The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has taken possession of the goods. 

To exercise your right of withdrawal, you must inform us (Healy International B.V., Paterswoldseweg 806, 9728 Groningen, Netherlands, phone: +31 507 995 084, e-mail: (contact.emea@healy.world) by means of a clear declaration (e.g. a letter sent by post, fax or e-mail) of your decision to revoke this contract. You can use the model withdrawal form for this purpose, but it is not mandatory. 

In order to comply with the withdrawal period, it is sufficient that you send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period. 

Please, note that products must be returned in their original condition. 

9.2 Consequences of the revocation  

If you revoke this contract, we shall reimburse you all payments we have received from you, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a type of delivery other than the most favorable standard delivery offered by us), without undue delay and no later than within fourteen days from the day on which we received the notification of your revocation of this contract. Please, note that no commission will be paid to your sponsor for returned items.  

The refund will be made using the same payment method you used for the initial transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees because of this repayment.  

For a smooth refund process, please consider the following: we may withhold the refund until   we have received the products back or until you have provided us with proof of return, whichever comes first. 

You are responsible for returning the goods without undue delay and in any event not later than fourteen (14) days after you have notified us of your decision to withdraw from the contract. The deadline will be deemed to have been met if you send the goods back before the fourteen (14) days have expired. You shall only be liable for loss of value of the goods if this loss is due to unnecessary handling by you to inspect the condition, properties and functioning of the goods. 

Please note that a return processing fee of 10€, or the equivalent amount in local currency, will be applied to all returns, from a total merchandise value of 150€ (or the equivalent amount in local currency). The equivalent amount in local currency may vary due to currency fluctuations or systematic calculations at the time of the return. This fee is non-negotiable and non-refundable. These costs will be deducted from the refunded amount, unless otherwise specified in the purchase contract with Healy World. For returns valued at less than 150€ (or the equivalent amount in local currency), Healy World will cover the return shipping costs. 

As a reference, for the deductions applicable to your local currency, please consult the table provided below.

9.3 Return Procedure 

To exercise the right of withdrawal, the consumer can also log in and submit a ticket in the Support Center, stating his name, e-mail address, telephone number and desire to return a Healy World product. Healy World will process the return and send the consumer a return label. The consumer must securely package the Healy World product, affix the return label, and take the package to the nearest drop-off location from the carrier. 

9.4 Exceptions to the right of withdrawal 

The right of withdrawal does not apply to the following contracts: 

(a) Contracts for the supply of goods which are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer. 

(b) Contracts for the supply of goods that are not suitable for return for reasons of health protection or hygiene, if their seal has been removed after delivery. 

9.5 Special offers 

In the case of promotional offers, any equipment and/or accessories that you received free of charge as part of your order must be returned along with the equipment and/or accessories that are not promotional items in order to receive a refund. 

  1. HEALY WORLD WARRANTY FOR CONSUMERS  

10.1 Healy World is liable for all material defects and defects of title that already existed at the time of sale. The warranty period for Healy World products and accessories is two years and starts from the day of receipt of the goods. 

10.2 For orders placed by 31.12.2021, it shall be presumed in the first 6 months that the defect already existed at the time of sale. For all orders placed after 01.01.2022, this period shall be 12 months. After this period, the customer must prove that the defect already existed at the time of sale. 

10.3 Excluded from the above restrictions are culpably caused damages to life, body or health or such which are based on an intentional or grossly negligent breach of duty by Healy World or a legal representative or vicarious agent. 

10.4 If operating or product instructions of Healy World and the manuals are not followed, changes are made to the products or other improper interventions are made, the warranty is void insofar as defects have arisen as a result. 

10.5 We ask for your understanding that we do not assume any warranty for wear parts of any kind.  

10.6 Accessories (electrodes, cables, charging cables, etc.): Accessories are subject to their own warranty conditions, as their service life depends on various factors. This warranty covers defects in material or manufacturing that affect the normal use of the accessories. The warranty does not cover damage due to improper handling, improper use, excessive strain or normal wear and tear. A warranty therefore only exists if a defect is due to a manufacturing error or a defect that was already present at the time of purchase. Use-related wear and tear and normal wear and tear of batteries are not covered by the warranty. 

Part B – CONCLUSION OF A HEALY WORLD SUBSCRIPTION  

In addition to purchasing a Healy device you can also take out a Healy World subscription via the website.  

  1. SCOPE AND USE OF THE HEALY WORLD SUBSCRIPTION 

11.1 Subscription for the devices  

The Healy World subscription grants you the right to use the Healy Programs and other services contained therein (“the services”).  

11.2 The Healy World subscription may not be used by other persons or organizations. 

11.3 We may offer some services on a monthly subscription basis, individually or as a bundle of different programs.  

  1. CONCLUSION OF THE CONTRACT 

The Healy World subscriptions can be taken out in accordance with the order process under point 2.  

  1. PRICES; TERMS OF PAYMENT  

13.1 Prices are displayed in Euro including VAT.  

13.2 If you decide to purchase a Healy World product at the same time as a Healy World subscription, the first payment is due from the date of your order and then on the same calendar day of the following month. 

13.3 Payment shall be made via the payment method selected by you in the ordering process. The following payment methods are available:  

  • Credit card: VISA, MasterCard, American Express,  
  • PayPal, SOFORT and iDEAL.

  1. DURATION AND CANCELLATION OF HEALY WORLD SUBSCRIPTION 

14.1 Duration and renewal of the Healy subscription for the devices 

A paid Healy subscription for your Healy or MagHealy has the minimum duration you choose when you sign the contract. If the paid subscription is not cancelled with one month’s notice before the end of the month, it is automatically renewed indefinitely depending on the type of subscription. If you have not cancelled the initial paid subscription our have not done so in time, you can cancel the renewal subscription at any time with one month’s notice.  

14.2 Duration and renewal of the Healy and MagHealy subscription 

A paid Healy or MagHealy subscription has a minimum duration that varies depending on the type of subscription you choose. If the paid subscription is not cancelled with one month’s notice before the end of the month, it is automatically renewed indefinitely depending on the type of subscription.   

1-month subscription (automatically renews for another month after expiry),  
3-months subscription (automatically renews for another three months after expiry), 
6-months subscription (automatically renews for another six months after expiry),  
12-months subscription (automatically renews for another twelve months after expiry). 

If you have not cancelled your initial paid subscription or have not cancelled it in time, you can cancel your renewal subscription at any time with one month’s notice.  

The option to renew a subscription with the maximum duration is only allowed after cancellation of the current subscription. In case of switching to a subscription with a longer duration in an existing subscription, the monthly payment date of the first subscription will remain valid until its expiry. 

MagHealy: The following discounts apply to subscription with longer durations and/or additional MagHealy applications: 

3-months subscription = 5% discount;  
6-months subscription = 10% discount;  
12-months subscription = 20% discount;  
MagHealy applications = 20% discount; 
MagHealy applications = 33% discount.  

In case of simultaneous purchase of a MagHealy and a subscription, we grant an extension of the subscription for 15 days, which includes the delivery period of the device. This period is granted after an expired subscription. Healy World grants this fixed subscription extension after an expired renewal subscription.  

HEALY WORLD RESERVES THE RIGHT TO UNILATERALLY MODIFY OR TERMINATE THESE SPECIAL TERMS AND CONDITIONS AT ANY TIME WITHOUT GIVING REASONS. 

14.3 Duration and renewal of the Business Suite subscription 

The Business Suite program offers three distinct subscription plans, each including a variety of modules: 

  • Sharer Bundle 
  • Team Builder Bundle 
  • Leader Bundle 

Please be aware that the names of these subscriptions are independent titles and do not correspond to the IHWM titles for Healy World members. 

Additionally, to register for the Business Suite subscription, you must be in possession of a Healy device and use the HealAdvisor analysis app. You can only gain exclusive access to the Business Suite program with both products. 

The subscription for Business Suite is on a monthly basis, with a minimum duration of one month. If the paid subscription is not cancelled with one month’s notice before the end of the month, it is automatically renewed indefinitely.  

14.4 Cancellation of subscription   

You may cancel any Healy World subscription(s) that you no longer desire by simply clicking the button in the Healy World Shop, under the tab “Subscription Management”, or by sending a message to mailto:contact.emea@healy.worldcontact.emea@healy.world.  

  1. UPDATES TO THE TERMS OF SUBSCRIPTIONS. 

Healy World reserves the right to adjust the prices of its subscriptions at specific times to reflect variations in the costs associated with the provision of our services. These adjustments may be due to variations in production costs, licensing, technical implementation, customer support, distribution (including billing and payment processes, marketing), administrative and other operational costs, as well as governmental charges such as taxes and duties. 

In the event of a price increase, Healy World undertakes to inform its customers at least 30 days in advance via email, using the address provided during registration. This communication will include specific details of the right of customers to cancel their subscription under these exceptional circumstances, the deadline for doing so, and the implications of not cancelling before the deadline. If cancellation is not made, the new price will apply from the next billing cycle of the subscription. Certain periods to reflect the impact of changes in the costs associated with our service. Cost factors affecting the price of our subscription offerings include production and licensing costs, costs associated with technical implementation, customer service and other distribution costs (e.g., billing and payment, marketing), general administrative and other overhead costs (e.g., rents, interest and other finance charges, staff costs, service providers and services, IT systems, energy), and government-imposed charges such as taxes and duties. Healy World will notify its customers of any price increase at least 30 days in advance by e-mail to the address provided at registration. Within the scope of the notification of the price increase, Healy World shall also specifically inform its customers of the extraordinary right of cancellation, which applies exclusively to price adjustments, of the cancellation period and of the consequences of a cancellation that is not affected in time. If the subscription is not cancelled, the new price will be applied to the customer as of the next monthly subscription charge date. 

Subscriptions can be modified at any time on the e-shop’s personal space, easily accessible from the web page by clicking on “Subscription Management”.  

  1. OPERATIONAL STABILITY AND MAINTENANCE OF THE SYSTEM 

Healy World’s subscription services are provided with the objective of ensuring maximum operational stability. However, Healy World assumes no responsibility for service interruptions caused by circumstances beyond its control. This includes, but is not limited to, power outages, equipment failures, problems with telecommunications connections, and other similar situations. Healy World undertakes to restore the service to normal operation in the shortest possible time in the event of any incident. 

Healy World reserves the right to make operational changes to the programs without prior notice, to make improvements or for any other reason, such as the development of software updates. It may be necessary on certain occasions to temporarily suspend access to the subscription services, generally at night, from 21:00 to 6:00 CET. In the event of scheduled interruptions, Healy World will endeavor to give sufficient notice of such breaks. 

  1. OWNERSHIP AND UPDATES OF PROGRAMS AND HEALY WORLD APPLICATION  

17.1 Ownership of Programs  

Full and exclusive title to the Healy programs and related custom software remains with Healy World, unless otherwise specifically agreed. Healy World has the right to assign its rights and responsibilities under this agreement to any subsidiary, associated business unit, or any affiliated entity or division at any time. Except as expressly mentioned, the rights and obligations under this agreement may not be assigned to any third party without the express written consent of the other party. In the event of such assignment, you will be given the right to terminate the contract. 

17.2 Updates and Modifications 

Healy World undertakes to provide updates to the applications as necessary and appropriate, reserving the right to issue additional updates at its discretion. In addition, Healy World retains the right to modify the applications in a manner that it deems reasonably acceptable to the customer, for example, through the development and improvement of the user experience. This right includes both technical and content adjustments. 

  1. LIMITATION OF HEALY WORLD’S LIABILITY 

Healy World has implemented reasonable precautions to ensure that the programs are free of malicious software. However, it cannot absolutely guarantee that the programs will always be free of such threats. Accordingly, to the fullest extent permitted by law, Healy World excludes all warranties of any kind, whether express or implied, with respect to the frequency programs, including, but not limited to, any warranties of merchantability or fitness for a particular purpose. 

Healy World’s liability to the customer for loss or damage, whether direct or indirect, is excluded to the maximum extent permitted by applicable law. This limitation of liability does not apply in cases of death or personal injury resulting from negligence on the part of Healy, its employees, or authorized agents, where there shall be no limit to liability. Other than in such cases, any liability of Healy shall be limited to the lesser of the payments made by the customer in the 12 months prior to the incident giving rise to the claim. 

ADDITIONNALY, THE DEVICES ARE NOT INTENDED TO CURE, TREAT, MITIGATE, DIAGNOSE, OR PREVENT ANY DISEASE OR MEDICAL CONDITION. THE TERMS USED IN THE PROGRAMS AND INSTRUCTIONS DO NOT CONSTITUTE STATEMENTS CONCERNING THEIR EFFECTS. 

  1. RIGHT OF REVOCATION 

You are entitled to a right of withdrawal in accordance with the following provisions.  

19.1 Cancellation policy  

You have the right to cancel this contract within fourteen days without giving any reason. 

The withdrawal period is fourteen days from the date of conclusion of the contract. 

To exercise your right of withdrawal, you must inform us (Healy International B.V., Paterswoldseweg 806, 9728 Groningen, The Netherlands, phone: +31 507995084, e-mail: contact.emea@healy.world) by means of a clear declaration (e.g. a letter sent by post, fax or e-mail) of your decision to revoke this contract. You can use the model withdrawal form for this purpose, but it is not mandatory. 

The timely dispatch of the revocation is sufficient to comply with the revocation period. 

19.2 Consequences of the revocation  

If you revoke this contract, we must return to you all payments that we have received from you immediately and at the latest within fourteen days from the day on which we received the notification of your revocation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees because of this repayment. 
We can refuse the repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier. 

If you have requested that the services begin during the withdrawal period, you shall pay us a reasonable amount corresponding to the proportion of the services already provided up to the time you notify us of the exercise of the right of withdrawal with respect to this contract compared to the total scope of the services provided for in the contract. 

  • END OF CANCELLATION POLICY –  

Please note that your right of withdrawal shall also expire in the case of a contract for the purchase of digital content if the execution of the contract has been commenced after you have agreed to the commencement of the execution of the contract on your part before the end of the withdrawal period and you have confirmed your knowledge that you thereby lose your right of withdrawal.

20.1 Protection of Personal Data

20.2 Security measures  

Healy World implements the necessary technical and organizational measures to ensure the protection and security of personal data, in accordance with legal requirements, preventing unauthorized access, disclosure, alteration or destruction of personal information. 

20.3 Confidentiality 

Healy World is required to maintain the confidentiality of personal information obtained and will not share it with third parties, except under the order of a court or competent regulatory authority and only to the extent strictly necessary. 

  1. SINGLE SIGN-ON SERVICES (SSOS) 

21.1 Implementation of OHS 

Healy World offers a single sign-on (SSO) system for customers to securely access various services and applications with a single ID, without the need for multiple registrations. Registration information is automatically and securely transferred to the system through a specialized interface. 

21.2 Responsibility of the customer 

Customers are responsible for the security of their access credentials and should avoid sharing these with third parties. Healy World reserves the right to modify or discontinue the SSO services at any time without prior notice, without assuming liability for damages arising from their use. 

21.3 Credential Management  

Customers can change their credentials or delete their account at any time. By using SSO authentication, they agree to these terms.  

  1. GENERAL PROVISIONS  

22.1 Legal compliance and Code of Conduct 

Failure to comply with these terms and conditions may lead to suspension or termination of your access to our services, without prejudice to any other legal rights or remedies we may have. 

The customer undertakes to comply with all applicable laws relating to the importation, sale, and distribution of the Products, informing the Company of any legislative changes that may influence the marketing of the Products. Furthermore, the customers undertake to defend and indemnify the Company against any legal infringement in the sale of the Products. 

22.2 Choice of Law and Arbitration  

Contracts between Healy World and the consumer shall be governed by the laws of the Netherlands, excluding the UN Sales Convention. However, this choice of law shall only apply to the extent that the consumer is not thereby deprived of the protection afforded to him by provisions which, under the law, may not be derogated from by agreement and which, in the absence of a choice of law, would have been applicable on the basis of statutory provisions. The statutory provisions on the restriction of the choice of law and on the applicability of mandatory provisions, in particular of the state in which the customer has his habitual residence as a consumer, shall remain unaffected. 

The place of jurisdiction for all disputes arising from the contractual relationship between the consumer and Healy World, is the competent court of the country in which Healy World has its registered office. 

The European Commission provides a platform for online dispute resolution (OS) at https://ec.europa.eu/consumers/odr/. Healy World is neither willing nor obliged to participate in the online dispute resolution pursuant to the Regulation on Online Dispute Resolution in Consumer Matters (ODR Regulation) or in a dispute resolution procedure before a consumer arbitration board pursuant to the Consumer Dispute Resolution Act (VSBG). 

22.3 Miscellaneous Conditions  

The failure of either party to enforce these Terms shall not be construed as a waiver of any right or provision. If any provision of these Terms is held by a court of competent jurisdiction to be invalid or unenforceable, such provision shall be eliminated without affecting the remaining terms. These Terms do not create any form of partnership, employment, fiduciary or agency relationship between Healy World and customer. 

22.4 Modification of Terms  

Healy World reserves the right to modify these Terms and Conditions at any time. Amendments shall be effective immediately upon posting on the official website or upon notice to customers by other appropriate means. Continued use of Healy World’s services and products following the posting or notification of such modifications shall constitute the customer’s acceptance of the new terms. It is the responsibility of the customers to periodically review the Terms and Conditions to be informed of any changes.
