Data protection information for Independent Healy World Member (IHWM) 

 

The protection of your personal data is important to us. Therefore, we always process your data in accordance with the applicable data protection regulations, in particular the General Data Protection Regulation (GDPR) of the European Union and the German Federal Data Protection Act (BDSG). This data protection notice explains which personal data is processed by Healy International B.V. (hereinafter “Healy”, “we”, “us”) as part of your membership as an Independent Healy World Member (IHWM).

Both companies are jointly responsible for the processing of your personal data. The data protection information is coordinated between the controllers in order to provide transparent information to the data subjects.   1. Purposes and legal bases of data processing

We process your personal data as part of your IHWM membership for the following purposes: 

 

2.1 Collection of personal data when concluding membership 

We collect the following personal data when you take out IHWM membership: 

  • First name and surname 
  • Date of birth 
  • Gender 
  • Company data (if applicable) 
  • Address 
  • Mobile phone number 
  • Email address 
  • Tax number, social security number, registration number (if required) 
  • iPayout account data 

These data are processed for the purpose of establishing, implementing and terminating the business relationship in accordance with Art. 6 (1) point b GDPR (contract performance). 

Important notice: Our services are aimed exclusively at persons who have reached the age of 18. Healy does not process personal data of children or minors. 

 

2.2. Collection of personal data during membership 

During your membership, we process your personal data for the following purposes: 

  • Managing the membership 
  • Processing deliveries and orders 
  • Sending advertising and information material (provided you have given your consent) 
  • Conducting training, webinars and events 
  • Processing payments and fulfilling tax obligations 
  • Complying with legal and compliance requirements 

The legal basis for this processing is Art. 6 (1) (b) GDPR (performance of a contract) and Art. 6 (1) (f) GDPR (legitimate interests). 

 

2.3. iPayout 

We use the payment service provider iPayout to process commission payments. As an IHWM member, you enter into a separate contract with iPayout, which in this context acts as an independent data controller in accordance with the GDPR. Healy only transmits the data necessary for payment processing to iPayout. This includes: 

  • Your full name 
  • Your account details (iPayout account) 
  • Your tax and identification information (if required) 

iPayout is independently responsible for the processing of this data. Please note that the processing of your data by iPayout is subject to iPayout’s privacy policy, which you can view at the following link:  

 

In addition, Healy processes certain iPayout-related data for identity verification and fraud prevention purposes. This includes verifying the identity and address data provided by iPayout to ensure that all transactions are carried out properly. This processing by Healy is carried out on the basis of our legitimate interest in accordance with Art. 6 para. 1 lit. f GDPR to prevent abusive and fraudulent activities. 

 

2.4. Use of the Healy BackOffice 

Our BackOffice is provided by the company Jenkon. Jenkon acts as a processor and provides the technical infrastructure for managing your IHWM membership. Personal data is processed as part of using the BackOffice, including: 

  • Email address 
  • password 
  • sales and performance data 
  • transaction data 

This data processing is necessary to provide you with access to the back office and to manage your IHWM activities. The legal basis for this is Art. 6 para. 1 lit. b GDPR (performance of a contract). Jenkon processes your data exclusively on behalf of Healy and in accordance with the applicable data protection regulations. For more information, please visit . 

 

2.5 Use of ZOHO for accounting 

We use the services of ZOHO Corporation for accounting and managing our financial obligations, including processing invoices and payments. In doing so, we process your personal data, such as: 

  • Name 
  • Contact details 
  • Payment information 
  • Transaction data 

ZOHO acts as a processor in accordance with Art. 28 GDPR and processes your data exclusively in accordance with our instructions. ZOHO ensures an appropriate level of data protection. The processing is carried out on the basis of our legitimate interest in accordance with Art. 6 (1) point f GDPR, in order to ensure proper accounting and payment processing. 

 

2.6 Disclosure of data in the genealogy and display in the webshop 

In order to support you as an Independent Healy World Member (IHWM) in expanding your business, certain personal data is shared with other IHWM as part of the genealogy. The following information can be displayed to your direct sponsors and members of your downline: 

  • Your name 
  • Your contact information 
  • Sales and performance statistics 

This data processing enables a transparent structure within the IHWM network and facilitates business cooperation and mutual mentoring. 

In addition, your first and last name and company name will be displayed in the web shop when a potential buyer enters your referral code. This function is used to assign the purchase to your IHWM account and to calculate any commissions. 

 

The processing is carried out on the basis of Art. 6 (1) (b) GDPR (contract performance) to fulfill your IHWM membership and on the basis of Art. 6 (1) (f) GDPR (legitimate interest) in promoting and supporting the business activities of our IHWM members. 

 

2.7 Use of data for advertising purposes and newsletter 

Advertising to customers: 

If you have provided your email address as a customer, Healy will occasionally send you emails to inform you of new products or special promotions. Each email contains the option to unsubscribe from future communications. The legal basis for this processing is your consent in accordance with Art. 6 (1) point a GDPR. 

 

Promotional activities regarding IHWM: 

Healy World will send you e-mails about current promotions, upcoming events and product launches, as well as annual meetings and recognition events. These communications are based on our legitimate interest in accordance with Art. 6 para. 1 lit. f GDPR, as it is crucial for our business operations that IHWM is always informed about developments in the company. 

 

2.8 Training and quality assurance 

Healy International B.V. processes your personal data for training and quality assurance purposes. This data comes from telephone calls (live and/or recorded), e-mails or other written communications. The legal basis for this processing is our legitimate interest in accordance with Art. 6 (1) point f GDPR, as it enables us to continuously improve our processes and your experience. 

 

2.9. Contact form and email contact 

If you use our contact form or email, we process the transmitted data to process your request. This usually includes the following data: 

  • Title 
  • First and last name 
  • Postal address 
  • Email address 
  • Telephone number 
  • Optional: order number, information about your Healy product 

The processing of personal data in the context of customer service is based on our legitimate interest in accordance with Art. 6 para. 1 lit. f GDPR to provide our members with the necessary support and to maintain our service quality, as well as on the fulfillment of contractual obligations in accordance with Art. 6 para. 1 lit. b GDPR in connection with your membership. All personal data processed through the ZOHO platform is treated securely and confidentially in accordance with the applicable data protection laws. 

 

2.10. Use of Telegram 

We offer some VIP customers the option of communicating with us via Telegram. Telegram acts as an independent data processor in this regard. Please read Telegram’s privacy policy at https://telegram.org/privacy/eu carefully. The use of this service is based on your consent in accordance with Art. 6 (1) point a GDPR. 

 

2.11. Healy World Academy 

The Healy World Academy at https://academy.healy.world offers training and webinars. Registration is done via the same access data as the BackOffice using Single Sign-On (SSO). The legal basis for this is Art. 6 (1) point b GDPR (performance of a contract). 

 

2.12. Reporting systems for legal violations 

As part of our compliance measures, we offer a whistleblower system that you can use to report violations. This also applies to human rights and environmental risks along our supply chains. This data is processed in accordance with Art. 6 (1) point c GDPR in conjunction with Section 10 HinSchG and Section 8 LkSG. 

 

  1. Data transfer to third countries

It may happen that personal data is transferred to countries outside the European Economic Area (EEA), e.g. when using third-party providers such as iPayout, Jenkon or ZOHO, which are based in the USA. For such transfers, we ensure that appropriate safeguards are in place, such as the application of standard contractual clauses in accordance with Art. 46 GDPR, to ensure an adequate level of data protection. 

 

  1. Security measures

Healy protects your data from unauthorized access, loss and destruction using technical and organizational measures. Our website is secured by SSL encryption to protect data during transmission. These security measures are continuously adapted to the state of the art. 

 

  1. Recipients of your personal data

Your personal data will only be passed on to third parties if this is necessary for the fulfillment of the contract or due to our legitimate interest. Recipients may include, among others, hosting providers, payment service providers and shipping companies. We have concluded data processing agreements with these external service providers in accordance with Art. 28 GDPR to ensure the protection of your data. 

 

  1. Duration of storage

Your personal data will be stored for as long as necessary to fulfill the stated purposes or as required by law. Subsequently, the data will be deleted or anonymized. 

 

  1. Rights of the data subject

As a data subject, you have the following rights under the GDPR: 

  • Right of access: You have the right to request information about your personal data processed by us. 
  • Right to rectification: You can request the rectification of inaccurate or incomplete data. 
  • Right to erasure: You have the right to request the erasure of your personal data, provided that there are no statutory retention requirements. 
  • Right to restriction of processing: You can request the restriction of the processing of your data. 
  • Right to data portability: You can request that we transfer your personal data to you or a third party in a structured, machine-readable format. 
  • Right to object: You can object to the processing of your personal data, in particular for direct marketing purposes. 
  • Right to revoke consent: You can revoke your consent to data processing at any time. 

You also have the right to file a complaint with the relevant data protection authority, in particular with the “Federal Commissioner for Data Protection and Freedom of Information” in Germany or the Dutch data protection authority.

You have the right to object to the processing of your personal data for reasons arising from your particular situation. This applies in particular to processing for direct marketing purposes.
